3. EligibilityParticipation is open to natural persons who are residents of Germany and at least 18 years of age at the time of entry.Employees of MILES Mobility GmbH and Hertha BSC GmbH & Co. KGaA, their family members, and any persons directly involved in the administration of the sweepstakes are excluded from participation.4. PrizeA total of 1 winner will be determined.The prize includes:2x VIP Event tickets to Hertha - FC Magdeburg Sunday 7th December 2025, 13:30Hr, Olympischer Platz 3, 14053 BerlinThe prize is non-transferable and cannot be paid out in cash or exchanged for other services.5. Prize Drawing and NotificationThe winner will be randomly selected from the total likes on the post.The winner will be contacted on December 1st 2025 via direct message on Instagram by MILES Mobility (@milesmobility). If no response is received within two (2) working days, the prize will go to the next person randomly selected from the total likes on the post.6. DisqualificationMILES Mobility GmbH and Hertha BSC GmbH & Co. KGaA reserve the right to disqualify any participant if there is reasonable suspicion of fraudulent behavior, manipulation, or breach of these Terms & Conditions. This includes, but is not limited to duplicate entries.Furthermore, MILES reserves the right to exclude individuals who have demonstrably caused harm to MILES, in particular by misusing services, breaching contractual obligations, or failing to settle significant outstanding payments despite reminders.7. Early Termination of the Sweepstakes and LiabilityMILES Mobility GmbH and Hertha BSC GmbH & Co. KGaA reserve the right to cancel or terminate the sweepstakes at any time for objectively justified reasons — in particular for technical, organizational, or legal reasons — without prior notice. This applies especially, but not exclusively, in the event of hardware or software malfunctions, other technical issues, force majeure, or external interference that prevents or significantly impairs the proper execution of the sweepstakes.MILES Mobility GmbH and Hertha BSC GmbH & Co. KGaA shall not be liable for disruptions or impairments to the sweepstakes that lie outside its sphere of responsibility. If such termination is caused by the conduct of a participant or a third party, MILES Mobility GmbH expressly reserves the right to claim compensation for any resulting damages.Liability on the part of MILES Mobility GmbH and Hertha BSC GmbH & Co. KGaA for damages — regardless of legal grounds — is excluded unless the damage was caused intentionally or through gross negligence, or results from a breach of essential contractual obligations (cardinal obligations). In such cases, liability shall be limited to foreseeable, typical damages. Statutory liability for injury to life, limb, or health remains unaffected.8.
